PRINCIPLE TO KNOW THE USERS OF NOTARY'S SERVICES IN RELATION TO RESPONSIBILITY OF NOTARY'S POSITION

The objectives of this research are to analyze the implementation of principle to know the users of Notary's services in the making of deeds, and to analyze the legal implication for Notary in the making and drafting of an authentic deed without applying the principle to know the service users. Method of this research is normative legal research, The characteristic of thiis research is prespective.

The results of the research are, firstly, in the framework to support prevention and eradication of money laundering/ prevention of terrorism funding, the implementation of principle to know the users of Notary's services, there are stages which must be performed, starting form identification of Notary's services utilized by the service users where the Notary must communicate in advance the service users that there will be information needed by the Notary in the effort of the identification and verification so that the monitoring on the service users regarding their identities and the sources of the clients' funds is in conformity with Regulation on the Minister of Law and Human Rights Number 9 of 2017 Concerning Application of Principle of Prudentiality becomes the ground in supporting the application of principle to know the users of services for the Notary to act as reporting party on suspicious transaction in Money Laundering Crime/Terrorism Funding ion order to avoid the legal implication to the Notary in the making of authentic deeds which does not apply the principle to know the service users.
