Abstrak: The election system is a manifestation of representative democracy. The types of legal research include normative legal research and descriptive research. The technique of collecting legal materials involves inventorying primary, secondary, and tertiary legal sources. The analysis method used is to examine the relevant legislative regulations. A weakness of the closed proportional system is that it reduces the interaction and intensity of party cadres with voters; candidates are reluctant to engage in campaigning, making it less suitable for new and small parties that are not well-known. Constitutional Court Decision No. 114/PUU-XX/2022 rejected the use of a closed proportional election system for the 2024 elections because the choice of the election system is determined by legislative policy, not a constitutional matter. An open proportional election system is more meaningful in a democratic sense compared to a closed system because it benefits both political parties and legislative candidates as well as the general public.

Abstrak: Sistem pemilu merupakan wujud dari demokrasi perwakilan (representative democracy. Jenis Penelitian: hukum normatif, penelitian deskriptif. Teknik pengumpulan Bahan Hukum dengan cara menginventarisasikan bahan hukum primer, sekunder, dan tersier. Metode analisis yang digunakan yaitu menelaah peraturan perundang-undangan yang dimaksud. Kelemahan sistem proporsional tertutup. Pertama, sistem proporsional tertutup mengurangi interaksi dan intensitas kader partai dengan pemilih, caleg enggan berjibaku dalam mengkampanyekan dirinya dan partai dan cenderung kurang sesuai untuk partai baru dan partai kecil yang belum terlalu dikenal. Putusan Mahkamah Konstitusi No. 114/PUU-XX/2022 menolak pemilu tahun 2024 menganut sistem pemilu proporsional tertutup karena yang menentukan sistem pemilu yang dianut adalah tertuang dalam kebijakan pembentuk undang-undang bukan urusan konstitusi. Sistem Pemilu proporsional terbuka secara demokrasi lebih berarti pada yang tertutup, karena baik partai politik maupun para calon legislatif dan masyarakat umum lebih diuntungkan dengan sistem pemilu proporsional terbuka dibanding dengan tertutup.
