Refusal of Notary Accepting Other Notary Protocols. The purpose of this study is to analyze why the Notary protocol file transfer is needed to other Notaries and to analyze the legal implications of the rejection of protocol archives based on the Theory of Rights and Obligations. The usefulness of this study, is expected to provide additional insight to Notaries in terms of the rules of obligation to accept protocols from other Notaries and their problems. Normative legal research methods are legal research conducted by reviewing legislation. The importance of the Notary Protocol archive to other Notaries is very important because the position of the Notary Protocol as a State archive must be maintained and guarded by the Recipient Notary and as an effort to maintain the juridical deed of Notary as a perfect evidence for the parties or their heirs about all matters contained in the deed if there is a problem or dispute between the parties regarding the deed in the future.The legal implications of the refusal of protocol archives by recipients of the Notary Protocol based on the Theory of Rights and Obligations are as follows: (1) Notary recipients of the Protocol do Unlawful Acts which not only violate the Law of Notary Position and Regulation of the Minister of Law and Human Rights Republic of Indonesia Number 62 Year 2016 concerning Amendments to the Regulation of the Minister of Law and Human Rights Number 25 of 2014 concerning Terms and Procedures for Appointment, Transfer, Dismissal, and Extension of Term of Office of Notaries but also violates the rights of others, especially the rights of interested parties in the deed. The recipient notary of the Protocol can be liable both from the aspect of state administration in Article 48 of the UUJN and civil aspects in Article 1365 of the Civil Code for the act of refusing other Notary Protocol records.
