The aims of this research are to study and analyze the status of residential or dwelling
house if the stay permit in Indonesia of a foreigner expires and to study and analyze the
its legal consequence to the status of residential or dwelling house. The ben
efits
expected from this research are as reference or resource for legal studies and as
information for the society in the ownership of residential or dwelling house by a
foreigner. This is normative legal research using statue approach wich is conducted b
y
analyzing all legislations related with the legal issues being studied, and conceptual
approach wich refers to the legal principles found in the legislation. The characteristic
of the research is prescriptive analysis which is aimed at explaining precise
ly the
characters of the individual, condition/ phenomenon of particular group/ in order to
determine the spread of a phenomenon in order to determine the presence or non
existence phenomenon in the society.
The results of the research are firstly, the re
quirements which must be fulfilled by a
foreigner domiciled in Indonesia as holder
of permit to purchase a residential or
dwelling house in Indonesia is foreigner who possesses stay permit in Indonesia in
accordance with the statutory regulations prevailin
g in Indonesia. Secondaly, the legal
consequence to the status of residential or dwelling house as a results of the expiry of
stay permit in Indonesia is the foreigner has to comply with the right and obligation
concerning the said residential or dwelling
house.
