ABSTRACT

State capital participation in the framework of establishment or participation in SOES whose
capital comes from the state budget is determined by Government Regulation. Minister of

Finance Decree Provisions of Article 2 and 3 of RI Law No.31 1999 Jo. RI Law No.20 of 2001
concerning the Eradication of Criminal Acts of corruption provides criminal acts for both
individuals and all ties he is a legal subject supporting the rights and obligations that are
responsible for his actions There are those who choose because of a position or the position that
can harm the State Finance or who can save the country is a crime of corruption.
From the results of research and discussion of the issues raised at least some conclusions can be
drawn. First, losses to SOES are not state losses. The position of the government in SOES
cannot be said to represent the state as a public legal entity. This is because the government as a
Public Legal Entity decides to include its capital in the form of shares in a BUMN which is a
Limited Liability Company, then at that time public and state immunity were lost and
disconnected from legal relations with changed state finances in the form of shares. Second, in
the event that the loss of an SOE is not a criminal offense, so long as there is no criminal act that
causes harm in the SOE, criminal responsibility cannot be requested for both the business entity
and its management.
