Penelitian ini dilakukan menggunakan metode penelitian yaitu, jenis penelitian hukum normatif, tipe penelitian kekosongan hukum, pendekatan masalah menggunakan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus, pendekatan sejarah dan pendekatan komparatif, sifat penelitian ini preskriptif, jenis dan sumber bahan hukum yang digunakan ialah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang diperoleh melalui studi kepustakaan. Dari hasil penelitian ini didapatkan bahwa Pertama, Hak Imunitas yang ada dalam Pasal 27 ayat (1) dan (2) Undang-Undang Nomor 2 Tahun 2020 tidak melanggar asas equality before the law, adapun Pasal 27 ayat (3) telah melanggar asas equality before the law. Kedua,Tolok ukur itikad baik dalam Undang-Undang Nomor 2 Tahun 2020 dapat dikonversi dari Asas Itikad Baik Pasal 24 Undang-Undang Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan..
