This dissertation comprehensively examines the regulation of the authority of the State Intelligence Agency (Badan Intelijen Negara, BIN) within Indonesia's national security law framework based on the 1945 Constitution of the Republic of Indonesia. The study focuses on three main research questions: first, how BIN's authority is regulated within national security law in accordance with the Constitution; second, the nature of intelligence agencies within the national legal system; and third, the reconstruction of BIN’s scope of authority as stipulated in the Constitution and its implementing regulations. This research applies a normative legal methodology with historical, conceptual, legislative, comparative, philosophical, and case study approaches.

The findings reveal existing legal gaps and socio-cultural challenges following the enactment of Law No. 17 of 2011 on State Intelligence, necessitating the re-regulation of BIN’s authority considering evolving strategic environments, democratic principles, human rights, organizational accountability, and political neutrality.

A novel contribution of this study is the development of a conceptual mechanism serving as a trigger for BIN’s authority, enabling the rapid, measured, and lawful activation of inter-agency intelligence coordination. This mechanism reinforces BIN’s role as a national intelligence integration center that is adaptive and responsive to the increasingly complex security challenges in the digital and globalized era. Accordingly, the dissertation offers innovative conceptual and policy foundations to enhance the effectiveness of Indonesia’s national intelligence system through transparent, adaptive, and democratic approaches.
