Penelitian ini melatarbelakangi pentingnya Usaha Mikro, Kecil, dan Menengah (UMKM) sebagai pilar fundamental ekonomi nasional yang sering kali menghadapi kendala keterbatasan literasi hukum serta akses terhadap regulasi perlindungan konsumen. Kasus penahanan pemilik Toko "Mama Khas Banjar" di Banjarbaru pada tahun 2025 akibat kelalaian administratif tidak mencantumkan label kedaluwarsa menjadi preseden nyata atas penegakan hukum yang kaku dan tidak proporsional. Penelitian ini bertujuan untuk menganalisis pengaturan kewajiban pelaku usaha mikro terkait informasi produk dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK) serta menguji penegakan hukumnya melalui kacamata prinsip proporsionalitas dalam perspektif hukum ekonomi. Metode penelitian yang digunakan adalah penelitian hukum normatif yang bersifat preskriptif dengan pendekatan undang-undang (statute approach), konseptual (conceptual approach), dan kasus (case approach). Hasil penelitian menunjukkan adanya ketidakselarasan normatif antara UUPK yang menuntut kepatuhan kaku dengan UU Nomor 20 Tahun 2008 tentang UMKM dan UU Nomor 18 Tahun 2012 tentang Pangan yang lebih mengedepankan aspek pembinaan serta sanksi administratif. Penegakan hukum represif berupa penahanan sejak awal dinilai tidak efisien secara ekonomi, mencederai prinsip ultimum remedium, serta gagal menerapkan UU Pangan sebagai lex specialis. Kesimpulannya, penegakan hukum bagi pelaku usaha mikro semestinya mengutamakan pembinaan dan sanksi administratif secara bertahap demi menjaga keseimbangan antara perlindungan konsumen dan keberlangsungan usaha kecil.

This research highlights the vital importance of Micro, Small, and Medium Enterprises (MSMEs) as a fundamental pillar of the national economy, which frequently encounter challenges such as limited legal literacy and restricted access to consumer protection regulations. The 2025 detention case of the owner of the "Mama Khas Banjar" Shop in Banjarbaru due to administrative negligence for not including an expiration date label serves as a clear precedent of rigid and disproportionate law enforcement. This study aims to analyze the regulations governing the obligations of micro-business actors regarding product information under Law Number 8 of 1999 concerning Consumer Protection (UUPK) and to evaluate its law enforcement through the lens of the principle of proportionality from an economic law perspective. The research method utilized is prescriptive normative legal research with a statute approach, conceptual approach, and case approach. The findings demonstrate a normative misalignment between the UUPK, which demands rigid compliance, and Law Number 20 of 2008 concerning MSMEs alongside Law Number 18 of 2012 concerning Food, both of which place greater emphasis on empowerment, guidance, and administrative sanctions. Repressive law enforcement, such as immediate detention from the outset, is deemed economically inefficient, violates the principle of ultimum remedium, and fails to implement the Food Law as a lex specialis. In conclusion, law enforcement targeting micro-business actors should prioritize phased guidance and administrative sanctions to maintain an equitable balance between consumer protection and the sustainability of small enterprises.
