ABSTRACT

Keywords : Consumer Protection, Online Personal Shopper Service (Jastip), Legal Certainty.

This study aims to determine the legal relationship between consumers, online personal shopper service providers (jastip), and sellers, as well as the form of liability of the online personal shopper service provider for consumer losses. This research is a normative legal study employing both a statutory approach and a conceptual approach.

The research findings indicate that: First, online jastip transactions combine a power of attorney agreement (Article 1792 of the Indonesian Civil Code) and a sale-and-purchase agreement (Article 1457 of the Indonesian Civil Code). The absence of specific regulations governing online jastip practices in Indonesia creates a "grey area" that reduces legal certainty, thereby placing consumers in a weak bargaining position and hindering the effectiveness of legal protection. Second, online jastip service providers bear full responsibility for all consumer losses, such as product defects, delivery delays, and fraud, pursuant to Article 4 letter h, Article 7 letter g, and Article 19 of Law Number 8 of 1999 concerning Consumer Protection (UUPK). Dispute resolution efforts can be pursued through non-litigation or litigation channels in accordance with the provisions of Article 45 of Law Number 8 of 1999 concerning Consumer Protection (UUPK).
